When we collect personal information directly from California consumers, we may provide a notice at or before collection describing:
- The categories of personal information collected;
- The purposes for which the information is used;
- Whether the information is sold or shared;
- Retention information where required;
- Applicable privacy rights; and
- Other information required by California law.
This Privacy Policy provides additional information concerning those practices.
California’s current regulations require a comprehensive privacy policy and specific disclosures concerning categories of personal information, purposes, sources, disclosures, retention, and consumer rights.
8. FACEBOOK AND INSTAGRAM LEAD FORMS
We may use Facebook and Instagram advertising and lead-generation tools operated by Meta Platforms, Inc.
When you submit a lead form through Facebook or Instagram, the information you provide may be transmitted to us.
Depending on the form, information may include:
- Name;
- Email address;
- Telephone number;
- Property information;
- Selling circumstances;
- Selling timeline; and
- Other information requested through the applicable form.
We may transfer this information into our CRM and lead-management systems for follow-up.
Meta separately collects and processes information under its own privacy policies and terms.
Your submission of a Meta lead form does not guarantee that:
- Your property will be purchased;
- You will receive a cash offer;
- You will receive a specific offer amount;
- You will receive a particular valuation;
- You will receive financing;
- Your property will be listed; or
- A transaction will occur.
9. CUSTOMER RELATIONSHIP MANAGEMENT AND LEAD MANAGEMENT
We may use third-party customer relationship management (“CRM”) and lead-management platforms to organize and manage information.
These systems may be used to:
- Store contact information;
- Track inquiries;
- Manage leads;
- Assign leads;
- Record communication history;
- Schedule follow-ups;
- Manage appointments;
- Send permitted communications;
- Maintain business records; and
- Generate internal summaries.
Access to information may be provided to authorized personnel and service providers who need the information to perform their functions.
10. AUTOMATED AND AI-ASSISTED TECHNOLOGY
We may use automated technologies and artificial intelligence (“AI”) to assist with certain business and communication functions.
These technologies may include:
- Automated lead follow-up;
- AI-assisted telephone systems;
- Automated scheduling;
- Conversation transcription;
- Conversation summarization;
- CRM automation;
- Email automation;
- SMS automation; and
- Other business-process automation.
An AI-assisted system may process information you provide to help us:
- Respond to an inquiry;
- Gather property information;
- Understand your requested service;
- Understand your preferred timeline;
- Schedule a follow-up;
- Create internal notes or summaries; and
- Route your inquiry to an appropriate member of our team.
Important limitation on AI
AI and automated systems are used as support tools.
They are not intended to independently make final decisions regarding:
- Property value;
- Whether to purchase a property;
- The terms of a real estate transaction;
- Whether a person qualifies for a real estate service;
- Whether a consumer should enter into a transaction; or
- Any other material real estate decision.
Final decisions and professional judgments are made or reviewed by appropriately authorized human personnel.
This is particularly important because the California Department of Real Estate has advised licensees that brokers remain responsible for supervising AI tools used in licensed activities and for ensuring that AI-generated communications are accurate and not misleading.
11. AI-ASSISTED PHONE CALLS
If we use AI-assisted or artificial voice technology to contact you, we will comply with applicable federal and California laws governing telephone communications.
Depending on the circumstances, we may:
- Provide required disclosures;
- Obtain required consent;
- Identify the purpose of the call;
- Provide appropriate opt-out instructions; and
- Honor applicable do-not-call or opt-out requests.
We will not represent an AI system as a human employee when disclosure is required or when doing so would be misleading.
The FCC has determined that AI technologies that generate or simulate human voices fall within the TCPA’s restrictions concerning artificial or prerecorded voice calls.
Important operational rule: submitting a telephone number alone should not be treated as blanket authorization for unrestricted AI-generated telemarketing calls.
12. TELEPHONE AND SMS COMMUNICATIONS
We may communicate with you by telephone, SMS/text message, or other electronic communications in connection with your inquiry or requested services.
Where required by applicable law, we will obtain appropriate consent before sending marketing text messages or making calls using artificial or prerecorded voice technology.
SMS Terms
Where you separately consent to receive text messages:
- Message frequency may vary;
- Message and data rates may apply;
- You may reply STOP to opt out;
- You may reply HELP for assistance; and
- You may contact us at 949-310-5183 or jenny@nxlgroup.com.
Opting out of marketing communications will not necessarily prevent communications that are necessary to complete a transaction, respond to a request, or comply with legal obligations.
Consent to receive marketing text messages is not a condition of purchasing goods or services.
13. CALL RECORDING AND TRANSCRIPTION
Where permitted by applicable law, telephone or other communications may be recorded, transcribed, or summarized for legitimate business purposes, including:
- Quality assurance;
- Customer service;
- Documentation;
- Lead management;
- Training;
- Compliance;
- Security;
- Transaction management; and
- Maintaining business records.
Where applicable law requires consent before recording or monitoring a communication, we will provide the required notice and obtain the required consent.
14. REAL ESTATE PROFESSIONALS AND TRANSACTION PARTIES
If you request real estate services or pursue a potential transaction, we may disclose appropriate information to parties reasonably necessary to provide those services or facilitate the transaction.
Depending on the circumstances, these parties may include:
- Real estate brokers;
- Real estate agents;
- Transaction coordinators;
- Title companies;
- Escrow companies;
- Attorneys;
- Lenders;
- Inspectors;
- Appraisers;
- Contractors;
- Service providers;
- Investors or potential transaction partners; and
- Other professionals involved in a potential or actual transaction.
We will disclose information only as reasonably necessary for the applicable purpose and as permitted by law.
15. SERVICE PROVIDERS
We may use third-party service providers to operate our business.
These may include providers for:
- Website hosting;
- CRM;
- Lead management;
- Email;
- SMS;
- Telephone services;
- AI technology;
- Data storage;
- Analytics;
- Advertising;
- Scheduling;
- Security;
- Information technology;
- Marketing;
- Transaction support; and
- Business administration.
These providers may process personal information on our behalf.
16. ADVERTISING, COOKIES, PIXELS, AND ANALYTICS
We may use cookies, pixels, tags, scripts, analytics tools, and similar technologies.
These technologies may help us:
- Understand website traffic;
- Measure advertising performance;
- Understand how visitors interact with our website;
- Improve our website;
- Prevent fraud;
- Analyze marketing campaigns; and
- Improve our services.
Third-party advertising and analytics providers may collect information directly from your browser or device.
You may be able to control certain cookies through your browser settings.
17. PERSONAL INFORMATION SOLD OR SHARED
We do not sell personal information for monetary consideration.
However, certain online advertising, analytics, or technology activities may constitute “sharing” of personal information under California privacy law even where no money is exchanged.
Where applicable California law gives you the right to opt out of the sale or sharing of personal information, we will provide and honor the applicable opt-out mechanism.
We do not knowingly sell or share personal information of consumers under 16 years of age.
